AI tools are now being readily used by businesses and consumers for a wide range of purposes. Whether you are supplying or using these tools, the implications for your business could involve:
GDPR. It is important to ensure that any AI tools are complying with GDPR or equivalent regulations. Potential fines for non-compliance are significant.
AI Regulations. The EU AI Act is already in force and other jurisdictions (including the UK) are likely to follow. Again, the potential fines for non-compliance are significant.
Copyright disputes. AI tools trained on large datasets could be infringing IP rights. Care is required when supplying or using AI tools, and you may want to challenge any AI providers that are unlawfully processing your/your client’s data.
Trade Mark disputes. Are your marketing team enabling AI powered tools on Ad Platforms such as Google or Meta Ads? Care is needed to avoid inadvertently finding yourself at the wrong side of a TM infringement claim.
Recruitment. Using AI tools can be tempting but presents a risk of breaching the Equality Act.
Terms & Conditions. Ensure your rights and interests in relation to any AI tools that you are using (or supplying) are not only understand, but well protected.
The scope for using or supplying AI tools to develop your business is huge, but so are the consequences of ‘getting it wrong’! If in doubt, make sure to contact the Techlaw team.
